TERMS & CONDITIONS OF GUARANTEE
1. GUARANTEE OVERVIEW
ImmigrationShop.ca guarantees that if you implement ALL recommendations provided in your Document Review Report and Immigration, Refugees and Citizenship Canada (IRCC) returns your application package due to incomplete or inadequate documentation, we will refund the full service fee of $500 USD.
2. WHAT IS COVERED
This guarantee covers application returns specifically due to:
- Inadequate work experience letters (missing required elements, improper format, insufficient job duty descriptions)
- Missing employment verification documents (T4s, pay stubs, NOAs, ROEs)
- Incomplete work permit documentation (gaps in legal status, missing permits)
- Document inconsistencies (conflicting dates, salaries, job titles across documents)
- Translation deficiencies (improperly certified translations, missing affidavits)
- Incomplete identity or civil status documentation (missing required certificates, photos)
- Missing required supporting documents that were identified in our review as necessary
3. ELIGIBILITY REQUIREMENTS
To qualify for a refund under this guarantee, you must:
a) Complete Implementation:
- Implement ALL recommendations provided in your review report
- Obtain all documents we identified as missing or requiring revision
- Make all corrections we specified to existing documents
b) Documentation of Compliance:
- Provide us with copies of all revised/corrected documents before submission
- Demonstrate that you followed each recommendation in our report
- Submit your application within the format and timeline we recommended
c) Timely Claim:
- Notify us within 30 days of receiving IRCC's return notice
- Provide complete documentation of the return (IRCC letter, explanation)
- Provide your complete submitted application package for verification
d) Good Faith Participation:
- Provided complete and accurate documents for our initial review
- Did not withhold information that would have affected our recommendations
- Responded to any clarification requests during our review process
4. WHAT IS NOT COVERED
This guarantee does NOT cover:
a) Partial Implementation:
- You implemented some but not all of our recommendations
- You modified our recommendations without consulting us
- You submitted different documents than we reviewed
b) IRCC Decisions Beyond Documentation:
- Eligibility determinations (IRCC decides you don't meet CEC requirements)
- Admissibility issues (criminality, security, medical)
- Misrepresentation findings
- Point calculation disputes
- Background verification issues
- Procedural fairness letters or interviews
c) External Factors:
- IRCC policy changes implemented after your review date
- NOC code reclassifications by IRCC
- Documents that expired between our review and your submission
- Third-party errors (employer refuses to revise letter despite our guidance)
d) Scope Limitations:
- Issues related to dependents not included in original review
- Provincial nomination documentation (unless specifically reviewed)
- Job offer validation (unless specifically reviewed)
- Proof of funds calculations (unless specifically reviewed)
e) Submissions Not Following Our Guidance:
- Application submitted more than 60 days after receiving our report (unless we approved extension)
- Application format different from what we recommended
- Additional documents added without our review
5. REFUND CLAIM PROCESS
Step 1: Notification (Within 30 Days) Email [email protected] with:
- Subject: "Guarantee Claim - [Your Name]"
- IRCC return notice (complete letter/email)
- Explanation of what IRCC identified as inadequate
Step 2: Documentation Submission (Within 7 Days) Provide:
- Complete application package you submitted to IRCC
- All revised documents you created based on our recommendations
- Evidence you implemented each recommendation from our report
- Original review report we provided
Step 3: Verification (10 Business Days) We will:
- Compare your submitted application to our recommendations
- Verify you implemented all suggested changes
- Review IRCC's stated reason for return
- Determine if the return was due to documentation issues we should have identified
Step 4: Decision (5 Business Days) We will notify you of:
- Approval or denial of your claim
- Specific reasons for our decision
- Refund timeline (if approved)
Step 5: Refund (If Approved - 10 Business Days)
- Full $500 USD refunded to original payment method
- Confirmation email sent
6. DISPUTE RESOLUTION
If your guarantee claim is denied and you disagree:
Reconsideration Request:
- Submit additional evidence within 14 days
- Explain why you believe the claim should be approved
- We will conduct secondary review within 10 business days
Final Decision:
- Our secondary review decision is final
- No further appeals available through ImmigrationShop.ca
External Options:
- Consumer protection remedies available under applicable law
- Professional complaints through licensing body (if you believe we provided inadequate service)
7. LIMITATIONS
Maximum Liability: Our total liability under this guarantee is limited to the $500 USD service fee. We are not liable for:
- IRCC application fees
- Cost of obtaining new documents
- Lost wages or employment
- Immigration consequences
- Emotional distress
- Any other direct or indirect damages
One Claim Per Order: This guarantee applies once per order. If you reapply after a return, a new review purchase is required.
Non-Transferable: This guarantee applies only to the original purchaser and cannot be transferred.
8. GOOD FAITH STANDARD
This guarantee is provided in good faith based on:
- Your complete disclosure during initial review
- Your accurate implementation of recommendations
- Your timely submission following our guidance
- IRCC's consistent application of documentation standards
We reserve the right to deny claims if we determine:
- You withheld information during initial review
- You misrepresented your compliance with recommendations
- You're attempting to abuse this guarantee
- Circumstances indicate bad faith
9. MODIFICATIONS
We reserve the right to:
- Modify these terms for future purchases (does not affect existing orders)
- Request additional documentation to verify claims
- Extend timeframes in cases of exceptional circumstances
- Waive specific requirements at our discretion
Notice of Changes:
- Terms applicable to your order are those in effect on your purchase date
- Changes will be posted on our website with effective date
- Existing orders governed by terms at time of purchase
10. DEFINITIONS
"Application Return": IRCC sends back your application package without processing it, specifically citing inadequate or incomplete documentation.
"Application Refusal": IRCC processes your application but refuses it based on eligibility, admissibility, or other grounds. (NOT covered by guarantee)
"Documentation Issues": Missing documents, improperly formatted documents, insufficient evidence, or document inconsistencies that IRCC identifies as reasons for return.
"Implementation": Obtaining revised documents, gathering missing materials, and correcting identified issues exactly as specified in our review report.
"Recommendation": Specific action item in your review report (e.g., "Obtain revised work letter including X, Y, Z elements")
11. LEGAL JURISDICTION
These terms are governed by the laws of Ontario, Canada. Any disputes will be resolved in Ontario courts.
